Our Terms and Conditions

Purchase Contract

This web site is operated by The Crumbly Cheese ("we", "us" or "our"). All purchases made on this web site are governed by these Terms and Conditions at any time although the Terms and Conditions governing any given purchase will be those in effect at the date of your order. If you order goods after we have published the changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the precise terms and conditions applicable to your purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date when these Terms and Conditions were most recently updated.

We will confirm acceptance of your order. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the email address you have provided to us. We may do both, in which case the acceptance will occur on whichever arrives sooner of the web message and the email. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.

All prices are in UK Pounds and are inclusive of VAT where applicable, at the current rate. The price of the goods will be as quoted on the web site at the time you confirm your order (usually by clicking the "checkout" button) subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order, the prices charged will be those applicable to the amended item(s) at the time that the amended order is confirmed. Please note that as promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer being offered.

The price of the goods does not include a charge for delivery.  The cutting of cheese is not an exact science and although we endeavour to cut as accuratley as possible sometimes you may recieve a fraction more or less than ordered. Once all items ordered are cut we ensure that you always have the amount of goods you have paid for if not more.  All cheese is weighed with packaging deemed necessary within the remit of our food hygene standards, and the manufacturers guide lines.

Although we endeavour to hold stock of all the items advertised for sale on our site this cannot be guaranteed so that by acknowledging receipt of your order we are not creating a binding contract to supply what you have ordered but which we do not have in stock. Images shown are for guidance only as products may vary from time to time as supplied by the manufacturer.     The content of the site is managed and therefore any products that are out of stock should be highlighted.

In the event of unavailability for whatever reason, we will advise you of our position when we receive your order and we will await your subsequent instructions.

We aim to deliver all orders within 2 working days subject to stock availability, and no longer than 7 working days. Orders placed before 10am on any of the delivery days will be dispatched that day, subject to available stock.

You will be notified by email the day your order is shipped. Your order will be delivered the following day (within the carriers remit).

Our delivery times are for guidance and are not a guarantee. We cannot take responsibility for length of delivery time once an item is dispatched from us to our carrier. Once an item is dispatched you become the owner of the goods and all issues arising therefrom.

If your order is a gift we will send it as quickly as possible and therefore, in the rare event of any specific cheese stock shortage we may substitute a cheese with a like for like replacement so as not to delay the shipment.

Delivery is sent overnight from us on a guaranteed next day delivery service. In most cases a signature is not required to acknowledge delivery. In order to give your cheese the best chance of getting to you in optimum condition we highly recommend adding a note in the box provided in the checkout of a suitable place to leave the order if you are not in or an alternative delivery address such as a nearby neighbour. NB this must be in the same street and block or within the immediate vicinity since a delivery to an extra address will be liable to an extra fee.

You must supply us with upto date contact details for your delivery and to the courier company and have some one available to recieve the goods or a safe place to store them. Failure to do so will incur a £30 re-delivery charge.

Dispatch for delivery will only take place on the following days :- Monday, Tuesday, Wednesday & Thursday.

Please note that certain parts of the British Isles including the Islands and the Scottish Highlands are harder to get to and therefore increase the chance of longer delivery times and higher charges.

Returns and exchanges

Returns are accepted only if the goods are damaged or faulty. You must inform us within 24 hours from receipt by email. We may request you return the item(s) to us in its original undamaged packaging. If the item has not been returned to us in the original packaging, we reserve the right to refuse a refund on the item(s). All returned goods must be returned with the delivery slip that accompanied the consignment. We will not accept items damaged during transit. Goods damaged in transit are your responsibility, and the couriers.

In the case of damaged, faulty or goods mistakenly shipped, a receipt for the return postage should be included within the package for the cost to be refunded, at our discretion.

In the case of goods returned unwanted or other means, you will be responsible for the whole cost of the product, including posting and packing to and from. Discretion may be granted by us.

None of the above terms affects your statutory rights if goods are damaged or incorrectly supplied nor does it affect your rights under the Consumer Protection (Distance Selling) Regulations.

Warranty and Liability

Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, neither will any of these terms restrict any of your statutory rights.

In addition that outlined above we will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war.

Other than as set out above, our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.
